While the stances, mayor John Cooper of Nashville, Tennessee is taking, appear increasingly bizarre, more of his constituents are finally waking up.
Last night, Cooper issued a 10pm curfew, leaving many Nashville residents stranded, without being allowed to go home or risk being arrested. This came after a rally, which mayor Cooper himself had promoted, saw the courthouse and City Hall, as well as countless businesses set on fire amid widespread violence and destruction.
Other city leaders, such as former mayoral candidate Professor Carol Swain, and city councilmembers, had warned the mayor of the potential violence that was looming. Warnings the mayor choose to ignore.
As his proposed 32% tax hike is threatening to chase away a large number of the businesses and residents who survived his ban on business and “safer-at-home”-order without going bankrupt or moving, and as Cooper is still not lifting all of the Covid-restrictions, despite empty hospitals, and despite Cooper himself not observing six feet distance at yesterday’s rally, many Nashvillians had enough.
State Representative Bud Hulsey and Senator Mark Pody proposed a law that would prohibit enforcement of executive orders violating a few of the most basic human rights, such as the freedom of movement, the right to run a business, or freedom to assemble.
When explaining the bill, Representative Hulsey took responsibility for recent overreach, rather than blaming the governor. Hulsey stated that he believes the legislator put the governor in an unfair position, by delegating legislative power to the governor. Hence, in Hulsey’s assessment, the legislator neglected its own responsibility toward the people and now it is the legislator’s duty to correct that mistake.
To be clear: the issue is not per se the fact that tech giants are deleting certain content, the problem is that they at the same time are claiming immunity from liability for criminal content posted by their users, by claiming to be a free and open platform, rather than a publisher.
However, legally, they cannot have it both ways. Either they permit anyone to post anything (with extremely narrow exceptions for clearly criminal content, as defined by federal law, not the platform’s own “community guidelines”), or they edit (as they are currently doing), in which case they are legally a publisher and legally responsible for the content posted on their platform.
In other words, if a company like Twitter continues to edit, censor, flag or delete content or accounts, based on the platform’s political preference, it cannot also claim immunity under federal law for the content it permits. So far, they have gotten away with doing both, contrary to what the law states.
On Thursday, President Trump now signed an executive order, clarifying the legal situation and instructing federal departments and agencies to draft guidelines to determine when a platform acts (and thus is to be treated as) a free and open forum, and when it acts as a publisher instead (and thus cannot claim immunity designated to free and open forums).
He also instructed federal agencies to look into how to classify these platforms – whether as publishers, or as free and open forums – given tens of thousands of complaints, filed by users all over the country, concerning the censorship performed by these companies.
As it stands right now, most of the big social media platforms will likely no longer get away with claiming immunity for content, given that most of them clearly chose to edit, flag and censor, thus acting as publishers. Thus, they will finally be held to the same standard as many smaller platforms have in the past.
This executive order promises to bring both justice and clarity, as it also articulates the standard for being treated as either a forum or a publisher. This way, a platform that actually chooses to act as a free and open forum (e.g. MeWe or Gab), rather than editing and filtering its content, will have more legal certainty as well.

A look at the actual data shows that there was never a reason to give up our normal lives or create an eerie “new normal.” As we now know, the models were wrong to an unimaginable degree and so was a lot of the mainstream media reporting about the Wuhan Coronavirus.
In Georgia, Covid-hospitalizations dropped 38% within three weeks of the state reopening, New York City, the country’s unrivaled Coronavirus-hotspot, had fewer than 100 Covid-19 deaths without preexisting conditions.
The study finds “Importantly, we detected SARS-CoV-2−reactive CD4+
T cells in ~40-60% of
unexposed individuals, suggesting cross-reactive T cell recognition between circulating ‘common cold’
coronaviruses and SARS-CoV-2.” (see last sentence of Summary).
In plain English, this means that 40-60% of the population has an immune system which is able to attack a Covid-19 infection, even without any prior exposure or vaccination.
Hence, only the remaining 40-60 % even needed to build immunity (via exposure to the virus) after the Coronavirus escaped the bioweapons lab in Wuhan, China.
Since about half the population had an immune-system, ready for the virus by default from the beginning, and every person who didn’t, builds immunity once in contact with the virus, the majority of the population can be expected to already be immune to Covid at this point.
