Supreme Court Unanimously Rules to Uphold Immigration Law

Aliens (i.e. non- U.S. Citizens or Nationals living in the U.S.) who entered the United States illegally without inspection or admission, are ineligible to adjust status (i.e. apply for permanent residency, commonly called “Green Card”).

A couple who lives in the U.S. and is tolerated under Temporary Protected Status (TPS), challenged this law. In an increasingly rare 9-0 decision, the United States Supreme Court upheld the law, ruling that the fact that the couple was later granted TPS does not change the fact that they entered the country illegally without inspection or admission and are hence ineligible for adjustment.
